Except as expressly stated herein or unless the context requires otherwise, the interpretation of terms under Section 4 of the Personal Data Protection Act 2010 shall apply to this notice.

This notice is issued to you pursuant to Section 7 of the Personal Data Protection Act 2010 regarding the personal data that you provide, which will be processed by us, Soo Thien Ming & Nashrah, and/or by our data processors on our behalf, in the ordinary course of business.
This notice shall apply even if you are not our client or if the personal data provided by you pertains to other persons you are representing, including the personal data of directors, shareholders, managers, and/or officers of a body corporate; partners, managers, and/or officers of a partnership; and office bearers of a society, club, or unincorporated body.

Personal Data Collected and Processed

The personal data collected and processed by us and/or our data processors may include your name, preferred name, gender, race, date of birth, age, photograph, nationality, identity card number, passport number, marital status, contact details, employment information, property details, bank accounts, banking facilities, and any other information that is proper, necessary or relevant for the purposes set out in paragraph 4.

Purpose of Personal Data Collected and Processed

The personal data are collected and processed by us and/or by our data processor for, among others, the following purposes:

to verify your identity and to communicate with you;
to render our legal services to you or our clients;
to facilitate billings and collections;
to ensure compliance with legal and regulatory requirements;
to enforce our rights or to defend against claims, complaints, or disputes;
to support our general operations and administration;
to maintain internal record-keeping;
to prevent, detect or investigate criminal activities;
to make disclosures as may be required by law, or by orders or directions of relevant authorities, including any court of competent jurisdiction; and
any other lawful purposes that is incidental, ancillary, or in furtherance to the above.

Sources of Personal Data

The personal data collected and processed by us and/or our data processors may be sourced, among others, from information you provide to us from time to time in the ordinary course of business, by any means and in any manner, as well as from reliable sources (whether governmental, government-linked, or otherwise) that are publicly accessible.

Disclosure of Personal Data

any persons as directed by or consented to by you;
any persons as required in the course of rendering our legal services, including but not limited to counterparties, governmental departments, statutory bodies, government linked bodies or corporates, and financial institutions;
any persons as required to comply with the legal and regulatory requirements;
any persons as required to enforce our rights or to defend against claims, complaints, or disputes;
the data processor appointed by us to process personal data on our behalf;
our consultants, lawyers, accountants, auditors, insurers, and any other professional advisors who are bound by confidentiality obligations towards us;
our sub-contractors or third-party service or product providers, as deemed necessary or appropriate in the ordinary course of business.

Non-Provision of Personal Data

You are not obligated to provide any personal data that you are unwilling to share with us.
You may limit the manner in which the personal data provided to us is processed.
You may withdraw your consent for us to process the personal data provided to us.

Security and Storage of Personal Data

We strive to take practical steps to implement appropriate administrative and security safeguards to protect the personal data provided to us, and to prevent the unauthorised or unlawful processing.
We may retain the personal data provided to us for such period as required by law or recommended by the Malaysian Bar, or for an extended period as we deem necessary to protect our interests.
We may transfer the personal data provided to us to third-party service or product providers within or outside Malaysia for any purposes set out in paragraph 4.
